These terms govern your use of 360° Foodie, including our website, app, ordering, and related services.

1. Agreement to terms

By accessing or using the 360° Foodie website, mobile application, or related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service.

We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.

2. Eligibility and account

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and place orders through the Service.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you suspect unauthorised access.

3. Orders and payments

When you place an order through the Service, you enter into a contract with the restaurant or merchant fulfilling that order. We facilitate ordering, payment processing where applicable, and delivery coordination.

Prices, availability, delivery times, and menu items are set by restaurant partners and may change without notice. Taxes, delivery fees, and other charges will be shown before you confirm your order.

You agree to provide accurate delivery details and to be available to receive your order. Failed deliveries due to incorrect information may not be eligible for a refund.

4. Cancellations and refunds

Cancellation and refund eligibility depend on order status, restaurant policies, and applicable law. Refund requests for eligible orders are handled according to our support processes and partner guidelines.

Promotional offers, vouchers, and discounts are subject to their own terms and may not be combinable unless stated otherwise.

5. Acceptable use

You agree not to misuse the Service, including by attempting to interfere with platform operations, submitting false orders, abusing promotions, harassing partners or support staff, or using the Service for unlawful purposes.

We reserve the right to suspend or terminate access to users who violate these terms or who pose a risk to other users, partners, or the platform.

6. Intellectual property

All content on the Service—including branding, logos, text, graphics, and software—is owned by or licensed to 360° Foodie and is protected by applicable intellectual property laws. You may not copy, modify, or distribute our content without prior written consent.

7. Disclaimers and limitation of liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties regarding uninterrupted access, accuracy of third-party content, or fitness for a particular purpose.

We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, except where liability cannot be excluded under applicable law.

8. Governing law and contact

These terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of courts in West Bengal, India, unless otherwise required by law.
